1. Acceptance of Terms

By accessing or using the Defensible Edge platform ("Platform") operated by Defensible Edge Labs, LLC ("Defensible Edge," "we," "us," or "our"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the Platform.

2. Description of Service

Defensible Edge is a community management platform for wildfire mitigation. The Platform provides tools for property inspections, action plan management, volunteer hour tracking, event coordination, and related reporting to support communities pursuing wildfire preparedness programs, including those aligned with the Firewise USA® recognition program administered by NFPA.

3. Accounts and Access

Access to the Platform requires an account. Accounts may be created by community administrators or by invitation. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

We reserve the right to suspend or terminate accounts that violate these terms or are inactive for an extended period.

4. Community Data

Community administrators are responsible for the accuracy of data entered into the Platform. Data is stored in isolated, per-community database schemas. Community data is accessible only to authorized users within that community and assigned consultants.

You retain ownership of all data you enter into the Platform. We do not claim ownership of your community data. We use your data only to provide and improve the Platform as described in our Privacy Policy.

5. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose
• Attempt to gain unauthorized access to other users' accounts or community data
• Interfere with or disrupt the Platform's infrastructure
• Upload malicious code or attempt to exploit vulnerabilities
• Scrape, crawl, or otherwise extract data from the Platform by automated means
• Impersonate another person or misrepresent your affiliation

6. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Defensible Edge does not warrant that the Platform will be uninterrupted, error-free, or secure. We do not guarantee the accuracy, completeness, or usefulness of any information on the Platform.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEFENSIBLE EDGE LABS, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR PROPERTY DAMAGE ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.

Our total liability for any claim arising from your use of the Platform shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

8. Professional Advice Disclaimer

The Platform is a management and reporting tool. It does not provide professional fire safety, forestry, or legal advice. Inspection results, risk assessments, and reports generated by the Platform are based on data entered by users and should not be considered a substitute for professional wildfire risk assessment by qualified experts. Always consult with qualified wildfire mitigation professionals for safety-critical decisions.

Defensible Edge™ is a trademark of Defensible Edge Labs, LLC.

Firewise USA® is a registered trademark of the National Fire Protection Association (NFPA). Defensible Edge is not affiliated with, endorsed by, or sponsored by NFPA or the Firewise USA® program. References to Firewise USA® on the Platform and marketing materials are for descriptive purposes only, to indicate compatibility with the Firewise USA® recognition program requirements.

10. Modifications

We reserve the right to modify these Terms of Use at any time. We will notify you of material changes by posting the updated terms on this page and updating the "Last updated" date. Your continued use of the Platform after changes are posted constitutes acceptance of the updated terms.

11. Governing Law

These Terms of Use are governed by the laws of the State of Idaho, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of the Platform shall be resolved in the courts of the State of Idaho.
